Depending on the content and functionalities of the site, the conditions and location of the Conditions of Use may differ.
Generally, if a website is passive the terms may cover such areas as a limitation of liability for the use of information, ownership of intellectual property rights and dispute resolution. In such a case it may be sufficient to provide a link to the Conditions of Use.

If the site is interactive, conditions related to the activities should be added. For instance, if personal data are collected a privacy statement is required. If visitors can order products the consequences of every step in the order process should be clarified. In such a case it may be required to display the conditions at the time the personal data are entered or the order is placed.

Proper consideration should be given to the legal entity stated in the Conditions of Use. Often this will be the legal entity that controls the website. However, sometimes there may be reasons to state another legal entity, such as the entity that collects the data, is party to the agreement or may be liable.
